Remuneration Tariffs

I. REMUNERATION FOR BROADCASTING, RETRANSMISSION AND COMMUNICATION TO THE PUBLIC BY MEANS OF TELECOMMUNICATION AND ON THE INTERNET

1. Public television stations

1 % from the income of the television station.

2. Public radio stations

1,5 % from the income of the radio station.

3. Commercial television stations

6. Communication to the public on the Internet:

6.1 Communication to the public of the radio station, broadcasting on the Internet (simulcasting)

Communication to the public on the internet of ethereal radio station broadcast.

The person who organizes and finances communication to the public on the internet pays the remuneration, which is counted by the method of calculation set out in Clause 6.1.1. or 6.1.2., choosing that method according to which the remuneration to the performers and producers of phonogram is higher:

6.1.1. 0,1 % from the income of commercial advertisement (additionally paid to the remuneration for broadcasting in ether);

6.1.2. according to the table:

Table explanation: The calculation of the maximum number of listeners is based on possibilities of the server, determining how many listeners can connect to one station at the same time or according to the number of the registered listeners provided by radio station, if such registration is necessary.

6.2 Communication to the public of the television station, broadcasting on the internet (simulcasting)

0,05 % from the income of commercial advertisement (additionally paid to the remuneration to performers and producers of phonograms for broadcasting in ether);

6.3. Radio station announcing its own programs publicly on the internet (webcasting)

Radio station works only on the internet. The person who organizes and finances communication to the public on the internet pays the remuneration.

If the contract is signed before the use of phonograms, and the remuneration to performers and producers of phonograms is paid in advance, remuneration tariff provided in Clause 7 can be decreased by 5 %.

II. REMUNERATION FOR COMMUNICATION TO THE PUBLIC OF PHONOGRAMS IN THE ENTERTAINMENT AND PUBLIC CATERING INSTITUTIONS

8. Restaurants, cafeterias, pubs, canteens, inns and similar institutions:

Notes: 1. If the user (before the visit of AGATA inspector or an official notice in written to sign the contract) applies by himself/herself to AGATA for signing the contract and honestly observes the terms of the signed contract, the discount mentioned below can be applied as it is provided by Republic of Lithuania Law on Copyright and Related Rights:

- If the restaurant, cafeteria, pub, canteen, inn or other similar institution works till 8 p.m., remuneration tariff provided in Clause 8.1 can be decreased by 12,5 %.

- If the contract is signed between the network of restaurants, cafeterias, pubs, music clubs, canteens, inns or other similar institutions and AGATA, linking 3 or more enterprises, the discount of 7,5 % to remuneration tariffs provided in Clause 8.1.can be applied.

2. If the temporary contract (for the summer season) is signed between the entertainment or public catering institutions and AGATA, the remuneration to performers and producers of phonograms is paid in advance for the term the activity permit is given. If the user stops the activity earlier and notifies AGATA about it properly as stated in the contract, the exceeding sum is returned.

3. If the discount is applied, minimum remuneration tariff cannot be less than 25 LTL/month.

9. Centers of entertainment, night and musical clubs, casino

III. REMUNERATION FOR COMMUNICATION TO THE PUBLIC OF PHONOGRAMS IN THE SHOPPING, SERVICE ENTERPRISES, ENTERTAINMENT AND OTHER SIMILAR INSTITUTIONS

10. Supermarkets, shops, service enterprises, bowling, lounges, solariums, hairdressing saloons, beauty salons and other institutions of similar purpose:

10.1. Trade, service enterprises, waiting-rooms, solariums, hairdressing saloon, beauty salons and other similar institutions:

1 LTL/year for one square meter of the shopping/visitors hall, when the music is broadcasted via radio and/or TV or phonograms are used, but not less than 25 LTL/year;

10.2. If phonograms are used in the area of the enterprise

50 LTL are additionally paid per year.

Note. 1. If the total area of halls of shops, service enterprises, lounges, solariums, hairdressing saloons, beauty salons and other similar institutions is less than 100 sq.m, the remuneration to performers and producers of phonograms is paid in advance for one year. If the user ends his activity and notifies AGATA about it properly as stated in the contract, the exceeding sum is returned.

2. If the user himself/herself (before the visit of AGATA inspector or an official notice in written to sign the contract), applies to AGATA for signing the contract and honestly observes the terms of the signed contract, one of discount mentioned below can be given as provided by Republic of Lithuania Law on Copyright and Related Rights (discounts cannot be summed):

- If the contract is signed between the network of trade, service enterprises or other similar institutions, linking 3 or more enterprises, and AGATA the discount of 7,5% to remuneration tariffs provided in Clause 10.1. can be applied.

- If the contract is signed between supermarkets or the networks of supermarkets and AGATA, and the total area of their halls is more than 50.000 sq. m. the discount of 15 % to remuneration tariffs, provided in Clause 10.1., can be applied.

11. Petrol stations:

11.1 If a pub, a cafeteria or other catering enterprise operates in the petrol station,

tariffs 8.1, 8.2 are applied;

11.2. if a shop operates in the petrol station,

tariff 10.1 is applied;

11.3. If music is used in the area of a petrol station,

50 LTL is additionally paid per year.

Note. 1. If the area of shops operating in the petrol stations or the total area of the petrol stations is less than 100 sq. m, the remuneration to performers and producers of phonograms is paid in advance for one year. If the user ends his activity and properly notifies AGATA about it as stated in the contract, the exceeding sum is returned.

2. If the user (before the visit of AGATA inspector or an official notice in written to sign the contract), applies by himself/herself to AGATA to sign the contract and honestly observes the terms of the signed contract, the discount mentioned below can be given as provided by Republic of Lithuania Law on Copyright and Related Rights:

- If the contract is signed between the network of petrol stations, linking 3 or more enterprises and AGATA, discount of 7,5% can be applied.

3. The minimum remuneration tariff cannot be less than 25 LTL/year.

IV. REMUNERATION FOR COMMUNICATION TO THE PUBLIC OF PHONOGRAMS IN THE INSTITUTIONS OFFERING SETTLEMENT AND REHABILITATION SERVICES

12. Hotels, motels, rest-houses, guest-houses, sanatoriums, SPA centers, camps and other similar institutions:

12. 1 hotels, motels, rest-houses, guest-houses, sanatoriums, SPA centers, camps and other similar institutions when ether radio/TV stations programs are broadcasting in the rooms

12,5 LTL/year for a room;

12.2 hotels, motels, rest-houses guest-houses, sanatoriums, SPA centers, camps and other similar institutions when satellite, cable radio/TV stations programs are additionally broadcasting in the rooms

25 LTL/year for a room;

12.3 hotels, motels, rest-houses, when music is broadcasting via radio and/or TV or when performance records or phonograms are used

1 LTL/year for a square meter of the hall or premises, intended for the rest and/or sports;

12.4 hotels, motels, rest-houses, when music is broadcasting via radio and/or TV, phonograms are used in the restaurant, coffee-house or pub, belonging to the hotel, motel, rest-house or in other catering or entertainment institution

Tariffs, indicated in 8.1, 8.2, 9 are applied.

Note. 1. If the temporary contract (for the summer season) is signed between the institutions offering settlement services and AGATA, the remuneration to performers and producers of phonograms is paid in advance for the term the activity permit is given. If the user ends his activity earlier and notifies AGATA about it properly as stated in the contract, the exceeding sum is returned.

- if contract is signed between the network of institutions offering settlement services that are linking 3 or more enterprises and AGATA, discount of 7,5 % can be applied.

3. The minimum remuneration tariff cannot be less than 25 LTL/year.

V. REMUNERATION FOR COMMUNICATION TO THE PUBLIC OF PHONOGRAMS IN LEISURE TIME OR SPORT ACTIVITIES AND EVENTS, AND IN PUBLIC PLACES

13. Discos and dances taking place in the cultural centre clubs, recreation centers and other similar institutions:

2 % from the amount of sold tickets, but not less than 25LTL;

If the user (before the visit of AGATA inspector or an official notice in written to sign the contract), applies to AGATA by himself/herself to sign the contract and honestly observes the terms of the signed contract, the discount mentioned below can be given as provided by Republic of Lithuania Law on Copyright and Related Rights:

- in case the contract is signed before the use of the phonograms and remuneration to performers and producers of phonograms is paid in advance, remuneration tariffs can be decreased by 5 %.

Tariff is not applied for the discos which are the part of an entertainment event.

The minimum remuneration tariff cannot be less than 25 LTL/month.

14. Entertainment events:

14.1 entertainment events with an entrance fee

2,5 % from the amount of the sold tickets;

14.2 entertainment events without an entrance fee

15. Light and sound show:

15.1. light and sound entertainment events with an entrance fee

1,5 % from the amount of the sold tickets;

15.2. light and sound entertaining events without an entrance fee

16. Dance contests and dance (modern, folk, ballet and etc.) performances:

1,5 % from the amount of the sold tickets, but not less than 100 LTL;

16.2. Dance contests and dance performances without an entrance fee

1,3 % from the received income (entrance, member, lesson price fee), but not less than 75LTL/month.

18. Fashion and beauty contests, fashion shows:

18.1. Fashion and beauty contests, fashion shows with an entrance fee

1 % from the amount of the sold tickets, but not less than 50LTL;

18.2. Fashion contests and fashion shows without an entrance fee

25 LTL for the demonstration of one designer’s collection;

18.3. Beauty contests without an entrance fee

19.2. Entertainment and recreational parks, amusement parks, carousels, skating-rinks without an entrance fee, when the following is used:

- In case the contract is signed before the use of the phonograms, and the remuneration to performers and producers of phonograms is paid in advance, remuneration tariffs provided in Clause 19.2 can be decreased by 5 %.

2. The minimum remuneration tariff cannot be less than 25 LTL/month.

20. Circuses

23. Sport events:

23.1. Sport events with an entrance fee (artistic performances on the ice)

1,5 % from the amount of the sold tickets, but not less than 100LTL;

23.2. Sport events when music is definitely used in the performances of sportsmen (fitness, synchronized swimming, rhythmic gymnastics, etc.)

1 % from the amount of the sold tickets, but not less than 75LTL;

23.3. Sport events when background music is used before the game, during the breaks or after the game

0,5% from the amount of the sold tickets, but not less than 50LTL;

23.4. Sport events without an entrance fee

26. Parks, streets and other public places

50 LTL/month.

27. Exhibitions of the artworks (short term exhibitions of the artworks during which phonograms are used)

2,5 LTL for the exhibition.

28. Theatre plays and other similar events:

28.1. music (using phonograms) is background or an important factor of a play, event (without an entrance fee)

VI. REMUNERATION FOR COMMUNICATION TO THE PUBLIC OF PHONOGRAMS IN THE PUBLIC TRANSPORT

31. Aircrafts:

31.1. Music during the aircraft’s take-off and landing

Tariffs, indicated in Clauses 8.1., 8.2., 9, are applied.

in case the contract is signed before the use of the phonograms, and the remuneration to performers and producers of phonograms is paid in advance, remuneration tariffs provided in Clauses 31.1., 31.2., 32., 33. 8.1, 8.2., 9 can be decreased by 5 %.
